Aihunters UAB (“the Company”, “we”, “us” or “our”) takes your privacy seriously. This Privacy Policy governs how we process personal data of the users (hereinafter, “Personal data”) when you install and/or use “EpiCentr” software application for mobile devices (hereinafter, the “App”, “our App”).

We take responsibility to protect your “Personal data” which has the meaning as set forth in the General Data Protection Regulation (further GDPR) in full correspondence with the applicable legislation. We are “data controller” for the purposes of the personal data processing under this Privacy Policy.

By using our app, you understand and agree with the Privacy Policy, otherwise you shouldn’t download or use the app.

The app is designed for individuals aged 13 years or older. We do not knowingly collect, hold, use or divulge any information from children under the age of 13, unless a parent or legal guardian has consented to it. If you believe that any information has been collected from children under the age of 13 without your prior consent, you may contact us via our contacts below.

AIHUNTERS UAB IS NOT A MEDICAL PROVIDER AND DOES NOT GIVE ANY MEDICAL ADVICE NOR MAKES MEDICAL DECISIONS RELATED TO YOUR HEALTHCARE. OUR APP IS NOT INTENDED TO BE A DIAGNOSTIC TOOL NOR A MEDICAL DEVICE. This Privacy Policy does not apply to your relationships with your medical provider, governed by the federal Health Insurance Portability and Accountability Act of 1996 (HIPAA).

Legal basis of data collection

The legal basis for the processing is the performance of a contractual relationship with the User (art. 6(1)(b) and (c) of the GDPR), including the Company legitimate interests to provide the services with its app. Purposes: To enable Users to use the App; to fulfill Company’s legal obligations and any other obligation eventually arising from the authorities’ instructions; to process any request for information and/or clarification raised by the Data Subjects (also by allowing them to contact our support staff).

DATA TRANSFERRING AND STORAGE:

All data when transferred off the end-user’s device is encrypted in transit, and is stored in a system with access controls and encryption. Transfer and storage of end-user data is compliant with Google’s Application Layer Transport Security (ALTS).

HOW WE USE YOUR INFORMATION:

We do our best to provide you with an amazing experience using our app. We use the information received from you as follows:

  • Account Information as set forth at p.1 is used to verify your identity when providing access to the app and your account; to prevent fraud or other unauthorized or illegal activity; to communicate with you regarding main app updates or special offers (with an option to opt-out from emails); to improve performance of our marketing activities (in case such information is provided to 3rd parties it is hashed or encrypted in the way making impossible to identify any particular individual).Your phone number will be used within the app’s functionality to send you Emergency Alerts via phone calls if you accept the Caregiver role. By accepting this Privacy Policy, you give us the corresponding consent.Your email will be used within the app functionality to send you emails, e.g. Emergency Alerts, guides on how to set up the app, marketing announcements etc. You will be able to opt-out from emails related to marketing announcements via links provided in those emails. However, under Caregiver role you may still receive Emergency Alerts by email since they are set up by the user you take care for. By accepting this Privacy Policy you give us the corresponding consent.
  • Health and Motion Information, as outlined in section p.2, is used solely for the app’s features and improvements. Specifically, it is used to detect seizure-like patterns, alert your Emergency Contacts, and enhance the accuracy of our algorithm through machine-learning.
  • Functional Information as set forth at p.3 above is used to make the app’s features working and to enhance the quality of our algorithm through machine-learning. It is never provided to third parties nor used for other purposes.
  • Request Information as set forth at p.4 is used solely for communication with you.
  • Analytics Information as set forth at p.5 above is used to monitor and analyze trends and app usage; to develop, improve, and refine products, services, and functionality; to improve the performance of the app and of our marketing activities.

HOW WE SHARE YOUR INFORMATION:

WE DO NOT SELL OR RENT YOUR INFORMATION. We may share your information only in the following ways:

Service Providers: We may share information about you with service providers who perform services on our behalf. In case we share some part of Account Information as set forth at p.1 above we hash or encrypt it in a way making impossible to identify any particular individual.

Compliance with Laws and Law Enforcement: We may share information about you in response to legal process or a request for information if we believe disclosure is consistent with, or required by, any applicable law, rule, or regulation; to investigate or remedy potential violations of our user agreements or policies, or to protect the rights, property, and safety of us, our users, or others; or in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

We may share information about you with your consent or at your direction, or as otherwise provided in this Privacy Policy. We may also share aggregated or de-identified information, which cannot reasonably be used to identify you.

Caregivers from your group: If you invite another user to your group as your Caregiver, you authorize us to share with that user some parts of your Account and Functional information (p.1 and 3 above) within the app functionality. If you delete that user from your group, all the information becomes unavailable to them.

HOW LONG WE KEEP YOUR INFORMATION:

We will keep your information only for as long as necessary to fulfill the purposes for which it was collected, or as required for our legitimate interests, or to comply with applicable legal, tax or regulatory requirements. After that time, we will destroy, delete or make all the information received anonymous.

ACCESSING YOUR PERSONAL DATA AND YOUR RIGHTS:

According to the GDPR and this Privacy Policy a user has the right to request from the Data controller access to and rectification or erasure of Personal data or restriction of processing concerning the data subject and to object to processing as well as the right to data portability. You have the right to withdraw consent at any time, without affecting the lawfulness of processing based on consent before its withdrawal.

IF YOU ARE A CALIFORNIA RESIDENT:

Under the California Consumer Privacy Act of 2018 (CCPA) California residents shall have the right to request:

  • the categories of personal information that is processed;
  • the categories of sources from which personal information is obtained;
  • the purpose for processing of user personal data;
  • the categories of third parties with whom we may share your personal information;
  • the specific pieces of personal information that we might have obtained about a particular user provided that the data given in the request is reliable enough and allows to identify the user

Please include the text “CCPA Request” into the Subject of your email.

When submitting a verifiable request, you should be ready to:

  • Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative, which may include: name, address, city, state, and zip code and email address. We may use this information to surface a series of security questions to you to verify your identity. If you are making a request through an authorized agent acting on your behalf, such authorized agent must provide written authorization confirming or a power of attorney, signed by you.
  • Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

We will not be able to respond to your request or provide you with personal information if we cannot: (i) verify your identity or authority to make the request; or (ii) confirm that the personal information relates to you.

We try to respond to a verifiable consumer request within thirty (30) days or we will inform you about exceeding time needed in a written form.
